Pesticides Rule Repeal/Replace Rulemaking
New Mexico Department of Agriculture is proposing amendments to the Pesticides rule 21.17.50.1 through 21.17.50.25 (NMAC) through the repeal/replacement process. Primary impactful changes from the existing rule include: change in expiration dates of annual licenses from December 31 to January 31; and increase in fees related to pesticide registrations and licenses. Expiration date was changed to address past issues related to an expiration date that occurred during the holiday season. Fee adjustments through the rule hearing process provides the department the ability to make periodic and incremental adjustment. Fee adjustments are necessary to help offset the increased costs of services, inspections, and licensing as a result of inflation and mandatory adjustments to staff salaries. The last fee adjustment to the Pesticides rule was made 2010.

Seed Standards Rule Repeal/Replace Rulemaking
New Mexico Department of Agriculture is proposing amendments to Seed Standards & Classifications 21.18.4 NMAC. The primary changes include removing the table in section 21.18.4.10 Germination Standards for Vegetable Seeds, and replacing with a reference to the federal seed act; Updating section 21.18.4.11 Methods of Sampling, to include refence to the federal seed act and the association of official seed analysts. Increasing fees in section 21.18.4.13 Fee Schedule for Seed Testing, to help offset the increased costs of services as a result of inflation and mandatory adjustments to staff salaries. The last fee adjustment to section 21.18.4.13 Fee Schedule for Seed Testing, was made in 1986.

Egg Inspection Rule Repeal/Replace Rulemaking
New Mexico Department of Agriculture is proposing amendments to Egg Inspection Fees 21.34.7 NMAC. Periodic adjustment of fees through the rule process provides the department the ability to make periodic and incremental adjustment. These adjustments are necessary to help offset the increased cost of services, inspections and licensing as a result of inflation and mandatory adjustments to staff salaries. The last year egg inspection fees were adjusted was 1985.
